Terms of use and liability disclaimer for the Mandaditos service of Weris App

What you accept in the app before every order

This summary is shown in Weris App before requesting a Mandadito. Accepting it means accepting these Terms and making the statements in section 4.

  1. It is a point-to-point transfer, not a purchase or an errand: our driver does not buy, does not pay, does not queue and does not run procedures for you.
  2. No chemicals, weapons, money, jewellery or anything illegal. The package must weigh less than 25 pounds and must fit in the driver's backpack. Weris disclaims all responsibility.
  3. Weris only connects you with the driver. It is not responsible for deterioration or delay. The packaging must be safe for transport by motorcycle. The driver may refuse the order if it does not meet the conditions.
  4. Weris covers up to a maximum of $35, and only for loss of the package while the driver carries it.
  5. If it cannot be delivered, the package goes back to the origin point. There is no rescheduling: a retry is a new order and it is charged to the person who handed over the package.

1. Definitions

For the purposes of these terms: MANDADITO is the WERIS platform service through which a User asks an independent Driver to pick up a package at an origin point and deliver it to a destination point, both within the coverage area, without making purchases, payments or procedures on the User's behalf. USER or SENDER is the person who requests the Mandadito from their account in the APP. RECIPIENT is the person designated by the User to receive the package. DRIVER is the independent courier affiliated with WERIS who accepts and carries out the transfer. PACKAGE is the object or objects the User hands to the Driver for transfer, closed and packed by the User. These terms supplement the WERIS User Terms and Conditions and Driver Terms and Conditions, which remain in full force.

2. Nature of the Service

WERIS is a technology platform that connects the User with independent Drivers. WERIS is not a transport, courier, messaging or storage company, does not take custody of the Package and does not take part in the transfer relationship between the User and the Driver beyond technological intermediation. A Mandadito is a point-to-point transfer: the Driver picks the Package up at the origin point given by the User and hands it over at the destination point given by the User, and nothing else. The Driver does not make purchases, payments, arrangements, queues or procedures of any kind on behalf of the User. Any such request will be refused and, if carried out by direct agreement between the User and the Driver, falls outside the platform and outside any liability of WERIS.

3. Acceptance of the Terms

By requesting a Mandadito the User declares that they have read, understood and fully accepted these terms, as well as the accuracy of the information and of the statements they check in the APP before confirming the order. Acceptance is recorded in the User's account and is deemed renewed with every new Mandadito. If the User does not agree with these terms, they must refrain from using the service.

4. User Statements about the Package

Before confirming each Mandadito, the User declares under their sole responsibility that: (a) the shipment is neither a purchase nor a procedure; (b) the Package does not contain chemicals, weapons, money, jewellery or any illegal or prohibited item; (c) the Package weighs less than twenty-five (25) pounds; (d) the value of the Package contents is under thirty-five US dollars (USD 35.00), which is the maximum amount WERIS covers in case of loss; and (e) the Package fits in the Driver's delivery backpack. These statements are part of the terms the APP shows and requires the User to accept before every order: accepting them is making the statements, and without that acceptance there is no order. WERIS may refuse or cancel any Mandadito that does not comply with them. Any false or inaccurate statement is the sole responsibility of the User, who shall bear the damages it causes to the Driver, to WERIS or to third parties.

5. Prohibited Items

The following may not be sent through Mandaditos, by way of example and without limitation: cash, cheques, securities or cards; jewellery, precious metals or stones; weapons of any kind, ammunition, explosives or fireworks; chemical, flammable, corrosive, toxic or hazardous substances; drugs, narcotics and controlled or prescription medicines; identity documents, passports or irreplaceable original documents; live animals; fragile items without proper packaging; goods whose value exceeds the declared limit; and any good whose possession, transfer or sale is illegal in the Republic of El Salvador. The Driver may refuse the order, without any penalty, if the Package does not meet the conditions of these terms —contents, weight, value, size or packaging— or if in their judgement it poses a risk to their safety.

6. Packaging, Pickup and Delivery

The User is solely responsible for packing the Package safely for transfer by motorcycle: closed, protected and with no loose parts. The Driver receives the Package closed, is not obliged to check its contents or internal condition, and may refuse it if the packaging is not safe. At the origin, the Package must be handed to the Driver by the person designated by the User; at the destination, it will be handed to the person designated as Recipient or, failing that, to whoever identifies themselves by that name at the given address. If nobody is available to receive the Package at the destination, the Driver will try to contact the Recipient and the User on the registered phone numbers. If delivery cannot be completed, the Package will be returned immediately to the origin point and handed to the person who gave it to the Driver. THERE IS NO RESCHEDULING of the delivery: a new attempt is a new Mandadito, with its own price, which the User must request from the APP. The cost of the return to the origin IS CHARGED TO THE PERSON WHO HANDED THE PACKAGE to the Driver, in cash and at the moment of the return. Delivery times are estimates and may vary due to traffic, weather, Driver availability or causes beyond WERIS's control.

7. Price and Payment

The price of a Mandadito is calculated from the distance between origin and destination and is shown to the User before confirming the order. The User chooses whether the shipment is paid at the origin or at the destination; in both cases payment is made to the Driver in cash at pickup or at delivery, as applicable. The price does not include tips or any additional cost arising from failed delivery attempts, extended waits or returns to the origin, which are charged as set out in section 6. A Mandadito cancelled after the Driver has started the trip to the origin may incur a cancellation fee.

8. Liability Disclaimer

The User acknowledges and accepts that they use the Mandaditos service at their own risk and that WERIS acts solely as a technological intermediary. Accordingly, and to the fullest extent permitted by law, WERIS shall not be liable for: (a) the damage, deterioration, breakage or total or partial destruction of the Package or its contents; (b) delays, failed deliveries or deliveries to a person other than the Recipient when the Driver followed the instructions given by the User; (c) the nature, legality, condition or value of the Package contents, which WERIS does not know; (d) indirect, incidental, special or consequential damages or loss of profit; or (e) force majeure or acts of God. Apart from the loss coverage in section 9, WERIS does not insure the Package, and any liability that could be attributed to WERIS shall in all cases be limited to the amount of that coverage. The User releases, discharges and undertakes to indemnify and hold harmless WERIS, its directors, employees, agents and affiliates against any claim, demand, penalty or action by third parties, including any authority, arising from the Package contents, from the falsity of the User's statements or from a breach of these terms.

9. Coverage for Loss of the Package

As the sole exception to the previous section, if the Package is lost, misplaced or stolen while in the Driver's possession —from the moment the Driver receives it at the origin until it is handed over at the destination—, WERIS will cover the loss up to a maximum of thirty-five US dollars (USD 35.00) per Mandadito. That is why the declared value of the Package must be under that amount: anything above USD 35.00 is not covered. The coverage is paid against a claim submitted within the period in section 11, with reasonable evidence of the contents and their value, and does not apply when the User breached the statements in section 4, sent prohibited items or handed the Package to someone other than the assigned Driver. The coverage does not extend to damage, deterioration or delays.

10. Driver Responsibility

The Driver is an independent contractor responsible for transferring the Package with due care from origin to destination. Any claim regarding the handling of the Package during the transfer shall be processed through WERIS User Support, which will act as a facilitator between the User and the Driver without thereby assuming any liability for the outcome.

11. Claims and User Support

Any claim related to a Mandadito must be submitted through the official WERIS support channels within twenty-four (24) hours of delivery, of the delivery attempt or, in case of loss, misplacement or theft, of WERIS or the Driver notifying the User of the event, stating the order number and attaching the corresponding evidence. After that period the service shall be deemed rendered to the User's satisfaction. WERIS may request additional information and reserves the right to resolve the claim in accordance with these terms.

12. Misuse and Suspension

Use of the service for unlawful purposes, sending prohibited items, false statements, disrespectful treatment of the Driver or repeated breach of these terms entitle WERIS to cancel the Mandadito, suspend or close the User's account without prior notice and, where appropriate, report the facts to the competent authorities.

13. Personal Data and Location

To provide the service, WERIS processes the contact details of the people who hand over and receive the Package, the origin and destination addresses and the Driver's location during the transfer. The User warrants that they have the authorisation of the Recipient and of the person handing over the Package to share their data with WERIS and with the Driver, solely for the purposes of the Mandadito. Data processing is governed by the WERIS Privacy Policy.

14. Amendments and Miscellaneous

WERIS may amend these terms at any time; the version in force is the one published on this site and applies to Mandaditos requested after its publication. If any provision is held invalid, the remaining provisions shall remain in full force. These terms are governed by the laws of the Republic of El Salvador and, for any dispute, the parties submit to the jurisdiction of the courts of San Salvador.
